3. Lot 2A Build-to-Suit Requirement

The buyer understands and acknowledges that the purchase of Lot 2A includes the requirement to construct a residence on the property with F & R Development serving as the builder.

The sale of Lot 2A is therefore offered as a build-to-suit opportunity and is conditioned upon the buyer entering into an acceptable construction agreement with F & R Development.

The residence and all related improvements must comply with:

  • Applicable recorded covenants and restrictions, commonly referred to as the “C&Rs”

  • Dakota Springs architectural standards and guidelines

  • Dakota Springs Architectural Review Board requirements

  • Approved architectural and construction plans

  • Builder specifications

The design, scope of construction, specifications, allowances, pricing, payment schedule, estimated construction schedule and responsibilities of the parties will be established through fully executed land purchase and construction agreements.

All plans are subject to final engineering, permitting, site adaptation, builder approval and approval by the Dakota Springs Architectural Review Board.

F & R Development reserves the right to make reasonable modifications or product substitutions when required by engineering, code compliance, product availability, construction practicality or improved building performance.

5. Square Footage and Dimensions

All square footage, room dimensions, ceiling heights and other measurements shown on this website are approximate.

Square-footage calculations may vary depending on the measurement method used and may include or exclude unfinished areas, garages, porches, basements, mechanical spaces and other areas.

Final dimensions and square footage will be determined by the approved architectural and construction documents.

6. Site Conditions and Development Costs

Preliminary pricing may be based on assumed site conditions. Actual conditions may not be fully known until surveys, soil evaluations, engineering, clearing, excavation or other site work has been completed.

F & R Development may substitute products with items of comparable quality, function and design when a specified product is discontinued, unavailable, delayed or determined to be unsuitable for the project.

Natural materials—including wood, stone and other finish products—may vary in color, grain, pattern, texture and appearance. These natural variations are inherent characteristics of the materials and are not considered defects.

8. Allowances and Buyer Selections

Any allowances included in preliminary or final pricing will be identified in the applicable construction agreement.

Buyer selections that exceed the stated allowance will increase the final contract price. Selections below the stated allowance will be handled according to the terms of the construction agreement.

Late selections, revisions or product changes may result in additional costs, redesign expenses, restocking fees or construction delays.

14. No Guarantee of Performance

F & R Development may incorporate building-science and high-performance construction principles into its projects. However, energy usage, utility costs, indoor air quality, humidity levels, sound transmission and overall home performance may be influenced by occupant behavior, maintenance, climate conditions, equipment settings and other factors outside the builder’s control.

No specific performance result, utility savings, health outcome or property-value increase is guaranteed unless expressly stated in a fully executed written agreement.

15. No Binding Agreement

This website and the information contained within it are not intended to create a binding agreement, formal offer, warranty, representation or contractual obligation.

No website statement, advertisement, rendering, photograph, email, estimate or preliminary discussion will modify the terms of a fully executed written agreement.

Final pricing, specifications, allowances, scope of work, schedule, warranties and obligations will be established only through fully executed land purchase and construction agreements with F & R Development.

In the event of any inconsistency between this website and a fully executed agreement, the executed agreement will control.
